Inderdaad, mijn foto, mijn intellectuele eigendom, is gestolen. Mijn foto’s worden soms door derden geleend. Geleend zonder netjes te vragen. Sommige mensen gebruiken mijn foto’s om hun spullen online te verkopen, of soms voor een artikel op hun website.

Deze keer was het een echt grote mensen professioneel museum. Hun reactie op mijn verzoek om deze zaak op te lossen met betrekking tot het gebruik van mijn foto zonder toestemming verbaasde mij hogelijk. Het ziet er naar uit dat het een slepende affaire gaat worden, maar ik hoop dat er uiteindelijk een goede afronding is, waar iedereen blij van wordt. Zelfs voor een zekere Jos.

Surfen naar foto’s en vriendelijk vragen

Het gebeurt wel vaker, mensen zoeken naar foto’s, lopen tegen eentje van mij aan die ze mooi vinden en gebruiken deze voor een bepaald doel. En soms kom ik daar achter. Dan vraag ik ze vriendelijk die foto van hun website of marktplaats te verwijderen en doorgaans doen ze dat dan ook. Vaak zeggen ze ook nog sorry. Ze dachten dat foto’s die je met je browser vind, gewoon gratis gebruikt mochten worden.

Ik hou er niet van als mensen mijn foto’s zomaar gebruiken. Ik heb ze immers speciaal voor mijn website gemaakt. Ik heb de nodige tijd en geld gespendeerd in een goede camera, het maken van een fotostudio, etcetera. I heb mijzelf geleerd hoe je zulke foto’s moet maken, heb alles klaargezet, de beste exemplaren geselecteerd en wat ge-edit op mijn PC. En ik deed dat allemaal om een leuke website te maken, met duidelijke en herkenbare foto’s.

Ik was een beetje aan het rondsnuffelen op internet, nadat ik een uitgebreid artikel had gepubliceerd over de T65, de telefoon op de foto. Ik was aan het uitzoeken of het artikel en de bijbehorende foto’s al op google te vinden waren.
Toen zag ik ineens een foto die ik herkende als eentje van mij. Maar er was maar een deel van te zien. Dat trok mijn aandacht en toen ik beter keek zag ik dat deze foto niet op mijn website stond, maar op die van Comm!

Wat is Comm?

Comm is de huidige incarnatie van ons voormalige PTT-museum. Het bestaat al vele decennia en onderging onlangs een grote gedaanteverwisseling. Het was voor enkele maanden gesloten en is pas opnieuw geopend. Het is gevestigd in Den Haag, niet ver van waar ik woon. Meer over Comm, klik hier.

Eerste contact 29-9-2018: vriendelijk vragen was niet genoeg

Dus, nadat ik een beetje bijgekomen was van de eerste verbazing, checkte ik grondig of het ook echt mijn foto was en checkte de datum dat ik de foto maakte, 23 april 2014 om 23.19 u, en stuurde ze een email op 29 september 2018.I legde uit dat ik zeer vereerd was dat ze mijn foto hadden uitgekozen, maar dat ik me niet kon herinneren dat ze toestemming gevraagd hadden. I heb ze ook verteld dat het me hogelijk verbaasde dat een professionele organisatie niet netjes om toestemming heeft gevraagd en dat ze niet eens aan bronvermelding deden. Ten slotte vroeg ik ze om de zaak fatsoenlijk op te lossen.

Ik voorzag de email van links naar de originele foto en naar de foto op hun website. En wachtte vervolgens op antwoord………dat nooit kwam. Hoewel ik toch echt een autoreply had gekregen waarin stond dat ze zo snel mogelijk antwoord zouden geven!

Tweede contact, 8-10-2018: verbazingwekkend antwoord

Toen ik na een week nog niets van ze had gehoord, besloot ik het anders te proberen. I had inmiddels uitgevonden dat ze dezelfde foto nog een keer op hun facebook hadden gebruikt. Dus postte ik er een reactie onder, wederom uitleggend dat de foto van mij was en dat ik al, zonder antwoord te krijgen en kopieerde mijn email in deze reactie, inclusief de links naar mijn foto en hun website. En wederom verzocht ik ze deze zaak op te lossen.
Hun reactie verbaasde me hogelijk. Het kwam er op neer dat het hen speet dat ik bij mij het idee was ontstaan dat de gebruikte foto de mijne was en dat zijn zorgvuldige procedures hadden waarbij ze zelf unieke foto’s maakten van hun eigen topstukken, om juist dit soort discussies over copyright te vermijden. Ze deelden natuurlijk mijn mening dat foto’s op elkaar leken en waren bereid hem te vervangen, als ik dat wilde.

Oplossen……

Ik vond hun reactie ontzettend neerbuigend en neigend naar beledigend. En dat he ik ook tegen ze gezegd en daarbij een fotomontage gepost (zie foto rechts) met aan de linkerkant een shot van hun website en rechts mijn foto die natuurlijk naadloos paste. Ik heb toen aangegeven dat ik hun reactie onacceptabel vond en dat ik de zaak elders zou aankaarten.

Hier reageerde Comm op door te zeggen dat zij mijn mening deelden dat er een grote overeenkomst was en dat hun zorgvuldige procedures schijnbaar niet correct gevolgd waren en dat zij de foto zouden verwijderen.
Huh? Wat? Gaven ze nu soort van toe dat die foto toch van mij was?
Nou ja, het speet ze in ieder geval dat ik aanstoot nam aan de toon van hun antwoord.

Ah, een nieuwe foto. Maar wacht eens even, dat is helemaal geen nieuwe foto!!!

Hierna begon ik dus aan dit blog. En terwijl ik aan het schrijven was, maakte ik allerlei screenshot van de verschillende berichten en natuurlijk van de Comm.nl website, toen me opviel dat na een paar dagen mijn foto eindelijk was verwijderd. Er was een nieuwe foto geplaatst, zie link.

“Goedzo, eindelijk” was mijn eerste gedachte. “He, dat is raar” was mijn tweede gedachte, aangezien de foto wat vreemd was, een beetje rommelig, niet in stijl met de rest van de website. Hij zag er een beetje amateuristisch uit. Ze zouden toch niet……………….

En jawel hoor, ze hebben gewoon effe een andere foto van internet geplukt. Ik vond het origineel na 20 sec, zie rechts. Gewoon de zorgvuldige procedure gevolgd, denk ik. Ze hebben Jos, degene die die foto postte, vast om toestemming gevraagd, denk je niet?

Na weer een paar dagen, op 10 oktober 2018, werd er weer een andere foto op gezet en dit keer zag het er wel uit als een professionele foto. Zie link. Voor de zekerheid heb ik nog even gezocht of het niet weer een foto van een andere wegsite was, maar kon deze foto nergens anders vinden. Schijnbaar duurde het een paar dagen voor ze een fotograaf hadden opgetrommeld om een foto te maken en deze op de site te zetten.

Dus wat nu?

Inderdaad, wat nu? Dit is geen mooi einde voor dit blog. Ik hoop dat er nog meer nieuws komt over deze affaire. Ik ben Comm over dit blog geïnformeerd. En dat niet alleen, ik heb ook nog een uitgebreide brief naar hun directeur geschreven, compleet met screenshots van het hele verhaal. Het PDF hiervan vind je hier: Brief directeur Comm

De inhoud van de brief correspondeert grotendeels met dit blog. Daarnaast heb ik laten merken hoe amusant ik deze episode tot nu toe vond. Ik heb afgesloten met het verzoek om nou eindelijk eens ruiterlijk toe te geven dat die foto van mij was, excuses aan te bieden voor al het gelieg en gedraai en verzocht om een excuus aan Jos, voor het ongevraagd gebruik van zijn foto.

Tenslotte heb ik de directeur uitgedaagd om er eens een happy end aan dit verhaal te bedenken. Zodat ik dit blog af kan sluiten op een manier waar iedereen blij van wordt. Dat zou toch mooi zijn?

Yes, my picture, my intellectual property, was stolen. My pictures are sometimes borrowed by third parties. Borrowed without asking. Some people use my photographs for selling their own stuff on line, sometimes for an article on their webpage.
And this time it was not some vintage tech-lover running his own website, or somebody selling a telephone of their own.

This time it was a proper grown up professional museum. And their response to my request to resolve the matter of unauthorised use of my photo surprised me to no end. It looks like this is going to be a continuing story, but I do hope there will be, eventually a good end to it, good for all parties involved. Even for this guy called Jos.

Browsing for pictures and asking nicely

It happens, people google around for pictures, find one of mine to their liking and use it for whatever end they please. And sometimes I find out. I surf around too. So I ask people kindly to remove these pictures from their site, which they usually do. Often they even apologise. They thought pictures they found with their internet browser were free to use.

I do not like people using my pictures. I made them especially for my website. I invested time and money in a camera, computer, making a photo studio, etc. I spent time learning to make these pictures, setting everything up to take them, selecting the best ones, and editing them on my pc. I did that all to make a nice website, with clear and recognisable pictures.

And then Comm used my picture….

I was browsing around on the net after I wrote an extensive article on the T65, the phone pictured. I was trying to find out if my newly published article was already listed in google searches. And suddenly I saw a photo that I recognised as one of mine. But it was only showing the phone partially. That drew my attention and when I looked at it, I saw that it was not on my website but on the website of Comm!

What is Comm?

Comm is the current incarnation of our National former PTT/Telecom museum. It has been around for decades and had a big make over a while ago. It was closed for months and has recently been re-opened. It is situated in the Hague, not very far from where I live. More about Comm, click here.

First contact 29-9-2018: asking nicely was not enough

So, after overcoming my surprise, I checked thoroughly if it was really my picture, checked the date that I took it, April 23rd 2014 at 23.19 hrs, and wrote them an email on the 29th of September 2018. I told them I was very much honoured that they used my picture, but that I did not recall them asking for permission. I also told them that I was surprised that a professional organisation failed to ask for permission and did not mention the source of the picture. I ended by asking how  they were going to resolve this matter.
I added links to the original picture on my website, and to the partial pictures used on their website.
And waited for a reply…………………which never came. Even though I did get an auto-reply stating that they would answer as soon as they could.

Second contact, 8-10-2018: baffling response

After hearing nothing for about a week, I decided to try something else. I found that they used the same picture again on their facebook, so I posted a comment under that picture explaining again, that it was mine, that I already emailed, got no reply and copied my email, including the links to pages on my website and their website on which that picture was used. And again I asked them to resolve this matter.
Their reaction surprised me to no end. Basically they said they were very sorry I got the idea that the photo used was mine and that they had a careful protocol where they made unique pictures of their own collection, to prevent discussion about copyright. They shared my opinion that the pictures were similar and were willing to change it, if I that was my wish.

Third response and it gets even crazier

I found their reaction extremely patronising, bordering on the insulting. So I told them that, and posted a picture (see picture on the right) showing how my photo fitted seamlessly on the photo on their website and told them I found this unacceptable and would take matters further.
They responded again, saying they shared my view that there was a big resemblance and apparently their careful procedures weren’t correctly followed so they were going to change the picture of the T65.
Ehm, did they just admit the picture was mine or not?
They were sorry that I found the tone of their first response offensive, though.

Ah, a new picture. But wait, that is not a new picture at all!!!

So I started writing this blog after that. And while I was writing it, I started to make screenshots of the various messages and of course of the Comm.nl website, when I noticed after a few days my picture was removed, finally. And they put up a new picture, see left.
“Good, finally” was my first thought. “Hey, that is weird” was my second thought, as the picture was a bit strange, haphazard, not in style with the rest of the website. It looked a bit amateurish. Surely they didn’t……………..

Yes they did, they got another picture from internet. I found the original after just 20 sec. See screenshot on the right. Following that careful protocol, I guess. I’m sure they asked Jos, the person who posted that picture, for his permission to use it, don’t you think so?

After another few day, on the 10th of October 2018, yet another picture was posted and this time it seems a real professional picture. Just to be sure, I searched the net again to see if it wasn’t a picture from another website, but could not find it anywhere. It seems to have taken them a few days to find a photographer to take the picture and put it up.

So, what now?

What now, indeed. This is not a proper ending to this blog. I hope there will be more news on this matter, one way or another. I informed Comm of this blog. Not only that, I wrote a long letter to their managing director, complete with screenshots of the whole story. I did not have time to translate it to English, but the contents correspond largely with this blog. I also expressed my amusement with this whole episode. And I ended with the request for them to recognise explicitly that it was my picture they used, for them to apologise to me about the lies and evasive behaviour and an apology for Jos for using his picture without permission.
And finally I challenged him to come up with a good and happy end to this story. So I could close this blog with in a way we could all be happy with. Wouldn’t that be nice?

  1. YES! I had a customer for my cords about 7 years ago. I had trouble getting tinsel wire and this man offered to go in with me and do them together. We discussed how I made the cords etc. Then he went in with another man I didn’t know and started saying his were the best cords and set about stealing all my customers. I am waiting for Karma to kick in and give him some hard lessons
